This privacy policy applies to all our services.

Your data subject rights

You can exercise the following rights at any time by contacting our data protection officer:

  • Information about your data stored by us and its processing (Article 15 GDPR)
  • Correcting incorrect personal data (Article 16 GDPR)
  • Deletion of your data stored with us (Article 17 GDPR)
  • Restriction of data processing if we are not yet allowed to delete your data due to legal obligations (Article 18 GDPR)
  • Opposition to the processing of your data by us (Article 21 GDPR)
    and
  • Data transferability, provided you have consented to data processing or have concluded a contract with us (Article 20 GDPR)

If you have given us your consent, you can revoke it at any time with effect for the future.

You may at any time submit a complaint to a supervisory authority, e.g. to the competent supervisory authority of the federal state of your residence or to the authority responsible for us as the responsible body.

Collection of general information when visiting our website or using other services from us

Information you provide us with

We collect information that you voluntarily provide to us, for example, when you enter a contest or promotion, communicate with us through third-party social media sites, request customer support, send us an email, or otherwise interact with us. The types of information we may collect about you include your name, screen names or social network IDs, email address, and any other information you voluntarily provide to us.

Nature and purpose of the processing

When you use one of our services (website, app, etc), i.e. if you do not register or otherwise submit information, information of a general nature is automatically collected. This information (server log files) includes, for example, the type of device used, the operating system used, the domain name of your Internet service provider, your IP address and similar.

They are processed in particular for the following purposes:

  • Ensuring that the website can be connected without problems
  • Ensuring smooth use
  • evaluation of system safety and stability, and
  • for other administrative purposes
  • develop new services
  • respond to your comments, questions and requests and provide customer service and support
  • send you technical bulletins, updates, security alerts, push notifications and support and administrative messages
  • To communicate with you about products, services, offers, promotions and events offered by JNK and others and to provide you with news and information that we believe may be of interest to you
  • Personalise and improve our services using profiles to provide targeted advertising, content or features
  • Monitoring and analysis of trends, usage and activities related to our services

We do not use your data to draw conclusions about your person. Information of this kind is analysed anonymously for statistical purposes, if necessary, in order to optimise our website and other services and the technology behind them.

Advertising networks

We may display advertising on our Services by displaying third party advertisements on our Services, but we may also advertise our own Services through third parties.

JNK may share your personal information with advertising networks for the purpose of direct marketing. For example, we may send your Advertising ID and IP address to advertising networks to enable our partners to display appropriate advertisements in accordance with GDPR Article 6(1)(f). “Advertising ID” means the Apple advertiser identifier (“IDFA”) on Apple and the Google Advertising Identity (“GAID”). These are unique identifiers for mobile devices. They are consistent across all apps and thus enable tracking across applications. These identifiers are used by advertising networks for a number of purposes in addition to targeted advertising, so we encourage you to review the privacy policies of our partners.

These ad networks may be located in countries outside the EU/EEA that have less restrictive privacy laws. For such advertising networks in countries outside the EU/EEA, the legal basis for the transmission is your consent in accordance with the GDPR Article 49(1)(a). You can opt out of all targeted third party advertisements for all applications by performing the opt-out at device level. If you are using an Apple device, you will find a guide to opt-out at https://support.apple.com/en-us/HT202074. If you are using an Android device, navigate to the Google Preferences page, select ads, and then choose to reset your Android Ad ID or opt out of targeted ads.

We may allow third parties to provide analysis services in connection with our services. These companies may use cookies, web beacons and other tracking technologies to collect information about your use of our services, including your IP address, MAC address, device IDs, software and hardware information, browser information, time zone and usage information. This information may be used by JNK and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests, and better understand your activities on our services.

Third-party ad serving and analysis technologies are integrated into our services. So if you do not wish to be subject to these technologies, do not use or access our services.

Our Services may also integrate third party application program interfaces (APIs) and/or SDKs that enable others to collect and process information about you, including but not limited to your geo-location information, in order to provide you with targeted advertising, offers and other content. You will always have the ability to control the collection and use of your geolocation information. You can disable location-based services at any time by adjusting the settings of your mobile device.

How we may share information

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • In response to a request for information, if we believe that disclosure is in accordance with applicable legal requirements
  • If we believe that your actions are inconsistent with the spirit or language of our User Agreements or policies, or to protect the rights, property or safety of JNK or others
  • In connection with or during negotiations for a merger, sale of company assets, financing or acquisition of all or part of our business to another company; and
  • With your consent or on your instructions.

We may also share aggregated information or otherwise anonymous information that cannot reasonably be used to identify you.

International data transfer

JNK operates worldwide and our services are global by nature. Your personal information collected through and/or by JNK may be stored anywhere in the world and may be transferred to and processed in countries other than the country in which you are located. These countries may have data protection laws that differ from the laws of your country.

When we transfer your personal information internationally, JNK takes steps to ensure that adequate security measures are in place to protect your personal information and that it is treated securely, lawfully and in accordance with this Privacy Policy.

Legal basis

Processing is carried out in accordance with Article. 6 para. 1 letter f GDPR on the basis of our justified interest in improving the stability and functionality of our website.

Recipient

Recipients of the data may be technical service providers who act as contract processors for the operation and maintenance of our website.

Storage duration

The data will be deleted as soon as they are no longer required for the purpose of the collection. This is generally the case for the data used to provide the website, when the respective session has ended.

In the case of storage of data in log files, this is the case after 14 days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are anonymised so that it is no longer possible to assign the calling client.

Provision required or necessary

The provision of the aforementioned personal data is not required by law or contract. Without the IP address, however, the service and functionality of our website and our services cannot be guaranteed. Furthermore, individual services and services may not be available or may be restricted. For this reason an objection is excluded.


Cookies

Nature and purpose of the processing

Like many other websites and services, we also use so-called “cookies”. Cookies are small text files that are stored on your end device (laptop, tablet, smartphone or similar) when you visit our website.

This provides us with certain data such as IP address, browser used and operating system.

Cookies cannot be used to start programs or transfer viruses to a computer. We can use the information contained in cookies to make navigation easier for you and to enable our web pages to be displayed correctly.

Under no circumstances will the data we collect be passed on to third parties or linked to personal data without your consent.

Of course, you can always view our website without cookies. Internet browsers are regularly set to accept cookies. Embedded YouTube videos

Nature and purpose of the processing

We embed YouTube videos on some of our websites and services. The operator of the corresponding plugins is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (hereinafter “YouTube”). When you visit a page with the YouTube plugin, a connection to YouTube servers is established. This will tell YouTube which pages you visit. If you are logged in to your YouTube account, YouTube can assign your surfing behaviour to you personally. You can prevent this by first logging out of your YouTube account.

If a YouTube video is started, the provider uses cookies that collect information about user behaviour.

Further information on the purpose and scope of data collection and its processing by YouTube can be found in the provider’s data protection declarations, where you will also find further information on your rights in this regard and setting options for protecting your privacy (https://policies.google.com/privacy). Legal basis

The legal basis for the integration of YouTube and the associated data transfer to Google is your consent (Article 6 para. 1 lit. a GDPR).

Recipient

The call to YouTube automatically triggers a connection to Google.

Storage period and withdrawal of consent

If you have deactivated the storage of cookies for the Google Ad programme, you will not have to expect such cookies when watching YouTube videos. However, YouTube also stores non-personal usage information in other cookies. If you want to prevent this, you must block the storage of cookies in the browser.

Google processes your data in the USA and has subjected itself to the EU_US Privacy Shield https://www.privacyshield.gov/EU-US-Framework.

Google AdWords

Nature and purpose of the processing

Our website and our services uses Google Conversion Tracking. The operating company of Google AdWords services is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. If you have reached our website via an advertisement placed by Google, Google Adwords will place a cookie on your computer. The conversion tracking cookie is set when a user clicks on an ad placed by Google.

If the user visits certain pages of our website or areas of our services and the cookie has not expired, we and Google can recognise that the user has clicked on the advertisement and been redirected to that page. Each Google AdWords customer receives a different cookie. As a result, cookies cannot be tracked across the websites of AdWords customers. The information collected through the conversion cookie is used to compile conversion statistics for advertisers who have opted in to conversion tracking. The customers will know the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

The legal basis for the integration of Google AdWords and the associated data transfer to Google is your consent (Article 6 para. 1 lit. a GDPR).

Receiver

Every time you visit our website, personal data, including your IP address, is transferred to Google in the USA. This personal data is stored by Google. Google may pass on this personal data collected via the technical process to third parties.

Our company does not contain any information from Google that could be used to identify the person concerned.

Storage duration

These cookies lose their validity after 30 days and are not used for personal identification.

Transfer to third countries

Google processes your data in the USA and has subjected itself to the EU_US Privacy Shield https://www.privacyshield.gov/EU-US-Framework.

Revocation of consent

If you do not wish to participate in tracking, you can refuse the necessary setting of a cookie – for example, by changing your browser settings to generally disable the automatic setting of cookies or to set your browser to block cookies from the domain “googleleadservices.com”.

Please note that you may not delete the opt-out cookies as long as you do not wish to record measurement data. If you have deleted all your cookies in your browser, you will have to set the respective opt-out cookie again.

To protect the security of your data during transmission, we use state-of-the-art encryption procedures (e.g. SSL) via HTTPS.

Individual right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(f) GDPR (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Article 4 No. 4 GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

Changes to our privacy policy

We reserve the right to adapt this data protection declaration so that it always meets the current legal requirements or to implement changes to our services in the data protection declaration, e.g. when introducing new services.
